Welcome to The Dude Club. These Terms of Use ("Terms") govern your access to and use of the website, events, services, products, and community platforms operated by The Dude Club ("Company," "we," "us," or "our").

By accessing or using our website, registering for events, joining our waitlist, purchasing merchandise, or otherwise interacting with The Dude Club, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.

1. About The Dude Club

Information You Provide to Us
The Dude Club is a community-focused brand that creates experiences, events, merchandise, and content designed to bring people together through shared values of character, camaraderie, and community. Our website and services may include community membership opportunities, paid and free events, brand merchandise, digital content and media, email communications and newsletters, event sponsorship collaborations, and online community engagement.

2. Eligibility

By using our services, you represent that you are at least 18 years old, or that you have the permission of a parent or legal guardian. You further represent that you have the legal capacity to enter into a binding agreement and that you are not prohibited by law from accessing our services. We reserve the right to suspend or terminate access if we believe a user does not meet eligibility requirements.

3. Acceptable Use

You agree to use The Dude Club website and services only for lawful purposes and in accordance with these Terms. You may not:

  • Violate any local, state, or federal law
  • Attempt to hack, disrupt, or compromise our website or systems
  • Harass, threaten, abuse, or harm other community members
  • Upload malicious code, viruses, or harmful software
  • Impersonate The Dude Club, its team, partners, sponsors, or other members
  • Use our platform for spam, unauthorized promotions, or solicitation
  • Attempt to access restricted areas of the website
  • Scrape, copy, or harvest data from our website without written permission
  • Engage in any conduct that could damage the reputation or operations of The Dude Club

The Dude Club reserves the right to remove content, suspend accounts, or permanently block users who violate these standards, in our sole discretion and without liability to you.

4. Community Conduct

The Dude Club is built on respect, inclusion, and positive community engagement. Users participating in events, discussions, or online community spaces agree to treat others with respect, foster a welcoming environment, avoid harassment, discrimination, or abusive behavior, and follow event guidelines and host instructions.

We reserve the right, in our sole discretion, to deny participation in events or remove individuals from community spaces if behavior violates these principles. The Dude Club is not responsible for the conduct of individual community members toward one another, and the Company's enforcement of these conduct standards does not create a guarantee of a particular community environment or expose the Company to liability for the behavior of its members.

5. Events—Assumption of Risk & Release

The Dude Club may host free or paid events including meetups, gatherings, activities, and community experiences.

Assumption of Risk
By registering for or attending any Dude Club event, you acknowledge and agree that participation may involve inherent physical, social, and situational risks. You voluntarily assume full responsibility for any risks of loss, damage, or personal injury that may be sustained as a result of participating in any event.

Express Release of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE The Dude Club, its officers, employees, volunteers, sponsors, partners, event venues, and contractors from any and all liability, claims, demands, actions, or causes of action arising out of or relating to any loss, damage, or injury — including death — that may be sustained at or in connection with a Dude Club event, whether caused by the negligence of the Company or otherwise.

Media Release
The Dude Club may photograph, video record, or otherwise document events for promotional purposes. By attending an event, you consent to being photographed or recorded and grant The Dude Club the right to use such materials in marketing, social media, and community content without compensation.

Event Policies
Additional event-specific terms — including ticketing, refunds, attendance limits, age restrictions, and safety guidelines — may apply at the time of registration. Those terms are incorporated into these Terms by reference.

6. Merchandise Sales

The Dude Club may sell branded merchandise through the website. By purchasing merchandise, you agree to the following:

  • All prices are listed in U.S. Dollars unless otherwise stated
  • Orders may be canceled or refused at our discretion, including in cases of pricing errors (see below)
  • Shipping timelines are estimates and not guarantees
  • All sales are final unless otherwise stated in our Return Policy
  • Refunds or exchanges are subject to our posted Return Policy, which may be updated from time to time
  • The Dude Club is not responsible for delays caused by shipping carriers, supply chain disruptions, or events outside our control

 

Pricing Errors
In the event of a pricing error on any product, The Dude Club reserves the right to cancel orders placed at an incorrect price, notify affected customers, and issue a full refund. We are not obligated to fulfill orders placed at an erroneous price.

 

International Orders
If The Dude Club ships internationally, you are responsible for any applicable customs duties, taxes, or import fees. The Dude Club is not liable for delays or seizures by customs authorities.

7. Intellectual Property

All content on The Dude Club website is owned by or licensed to the Company, including logos, brand identity, designs, artwork, written content, videos, media, event materials, and digital assets. These materials are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, sell, modify, or use our branding or content without prior written permission from The Dude Club. Unauthorized use may result in legal action, including claims for injunctive relief and monetary damages.

8. User Submission & DMCA Policy

License Grant
If you submit content to The Dude Club (including comments, photos, ideas, testimonials, or community content), you grant The Dude Club a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display that content for marketing, promotional, or community purposes. You confirm that you own the rights to the content you submit or have permission to share it.

You may revoke this license by contacting us at support@thedudeclub.org. Revocation applies to future use only and does not require removal of content already incorporated into published materials. We reserve the right to remove user-submitted content at our discretion.

 

DMCA / Copyright Takedown Policy
If you believe that content on The Dude Club website infringes your copyright, please submit a written notification to our designated DMCA agent at:

Your notice must include: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material and its location; (3) your contact information; (4) a statement of good-faith belief that use is not authorized; and (5) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

The Dude Club will respond to valid DMCA notices promptly and will remove or disable access to infringing material where appropriate.

We are not responsible for the content, policies, practices, products, services, or conduct of third-party websites or services. Your interactions with sponsors or partners are between you and those organizations.

Event Sponsors
Sponsors present at Dude Club events operate independently. The Dude Club is not responsible for any products, services, representations, or conduct of event sponsors, and your interactions with them do not create liability for The Dude Club.

 

FTC Affiliate Disclosure
Some links on our website or in our communications may be affiliate links, meaning The Dude Club may receive compensation if you make a purchase through those links. Affiliated or sponsored content will be clearly labeled as such. Our editorial opinions are not influenced by affiliate relationships.

10. Email Communication & CAN-SPAM Compliance

By signing up for our waitlist, events, or community updates, you consent to receive marketing and informational emails from The Dude Club. These may include event announcements, community updates, promotions, and merchandise offers.

The Dude Club does not send sponsor promotional emails on behalf of third parties without your separate opt-in consent to receive such communications. Our emails comply with the CAN-SPAM Act: each email will include a clear identification of the sender, a physical mailing address, and an unsubscribe mechanism. You may unsubscribe at any time using the link in any email. Unsubscribe requests will be honored within 10 business days.

11. Privacy

Your use of The Dude Club website is governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, store, use, and protect your personal information, and describes your rights as a user. We encourage you to read it in full.

12. Disclaimer of Warranties

THE DUDE CLUB PROVIDES ITS WEBSITE, EVENTS, SERVICES, AND MERCHANDISE "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE MAKE NO GUARANTEES REGARDING WEBSITE AVAILABILITY, ERROR-FREE OPERATION, ACCURACY OF INFORMATION, CONTINUOUS ACCESS, EVENT SCHEDULING OR CONTENT, AVAILABILITY OF MERCHANDISE, OR PERFORMANCE OF THIRD-PARTY SERVICES.

To the fullest extent permitted by law, The Dude Club disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be waived.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DUDE CLUB AND ITS OFFICERS, EMPLOYEES, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • Use of or inability to use the website
  • Participation in events
  • Purchase of merchandise
  • Interactions with other community members or sponsors
  • Cancellation, postponement, or modification of any event
  • Unauthorized access to or alteration of your data

Our total aggregate liability for any claim shall not exceed the greater of (a) the total amount paid by you to The Dude Club in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow limitation of certain damages. In those cases, the limitation applies to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless The Dude Club and its officers, employees, contractors, partners, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of our website or services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any content you submit to The Dude Club. This obligation survives termination of these Terms.

15. Termination of Acess

The Dude Club reserves the right to suspend, restrict, or terminate your access to the website or services at any time if you violate these Terms, engage in harmful conduct, or for any other reason at our sole discretion. Where practicable, we will notify you of termination. For paid services or ticketed events, we will honor refund obligations as required by applicable law or our posted refund policy. Termination does not limit any other remedies available to The Dude Club.

16. Changes to These Terms

We may update these Terms of Use periodically. When we make material changes, we will revise the "Last Updated" date at the top of this document and will provide reasonable notice to registered users via email. For non-material changes, posting the updated Terms on this page constitutes sufficient notice. Continued use of the website after changes are posted or communicated constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use of our services.

17. Governing Law & Venue

These Terms are governed by and interpreted in accordance with the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute not subject to arbitration under Section 19 shall be brought exclusively in the state or federal courts located in Kendall County, Illinois. You consent to personal jurisdiction in those courts.

19. Dispute Resolution, Arbitration & Class Action Waiver

Informal Resolution First
Before initiating any formal legal proceeding, you agree to contact The Dude Club at support@thedudeclub.org and give us 30 days to resolve the dispute informally. Most issues can be resolved this way.

Binding Arbitration
If a dispute is not resolved informally, you and The Dude Club agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services — including the enforceability of this arbitration provision — will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in Cook County, Illinois (or by remote hearing). The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

CLASS ACTION WAIVER
YOU AND THE DUDE CLUB EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED PROCEEDING, OR REPRESENTATIVE ACTION. ALL DISPUTES MUST BE BROUGHT INDIVIDUALLY.

Exceptions
Nothing in this Section prevents either party from seeking emergency injunctive relief in court to prevent irreparable harm, or from bringing claims in small claims court for matters within that court's jurisdiction.

20. Force Majeure

The Dude Club shall not be liable for any failure or delay in performing its obligations — including hosting events, delivering merchandise, or providing services — caused by circumstances beyond our reasonable control. This includes, but is not limited to: acts of God, natural disasters, pandemic or public health emergencies, government orders or restrictions, venue failures or closures, labor disputes, transportation disruptions, power outages, cyberattacks, or acts of war or terrorism.

In the event of a force majeure affecting a paid event, The Dude Club will make commercially reasonable efforts to reschedule or provide a credit. Refunds due to force majeure cancellations are at the Company's discretion, except where required by applicable law.

21. Entire Agreement & Severability

These Terms, together with our Privacy Policy and any event-specific terms, constitute the entire agreement between you and The Dude Club regarding your use of our services and supersede all prior agreements or understandings. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
